VIOLATION OF PROBATION
When you are placed on probation or community control, the judge will advise you of the conditions of that supervision. It is your responsibility to abide by the terms of your probation or community control. In the event that there is a violation, a Judge will be asked to sign a warrant for your arrest and you may be kept in the County Jail, without bond, pending the results of the Florida probation violation hearing. At the time of the hearing, the burden of proof is by preponderance of the evidence, rather than beyond a reasonable doubt. In addition, you have no right to a trial by jury. However, the State must prove that the violation was willful and material. While the burden of proof is less for the state on a probation violation, there are viable defenses. Don't suffer the consequences for probation violations. When your liberty or the liberty of a loved one is on the line you will need an experienced attorney.
